Standard Terms and Conditions of Trading

ALL QUOTATIONS ARE SUBMITTED AND ALL ORDERS ARE ACCEPTED ONLY ON THE BASIS OF FOLLOWING TERMS AND CONDITIONS OF SALE

Payment

Payment by account customers shall be made by the end of the month following that in which the goods are invoiced. If payment remains unpaid by the time it is due, a creditor surcharge shall be payable by the customer at the current rate as stipulated on the sales invoice for each month for which the account remains unpaid. Non-account sales will be on a pro forma basis. Credit accounts may be opened subject to approval by completion of a credit application form

Liabilities

The invoice value of any goods made by us and subsequently agreed by us to be defective, will be credited to the customer's account provided that we are advised of the defect within 28 days of dispatch. Any defective goods will be replaced or made serviceable free of charge, our liability is limited to the cost of exchange of the goods, and no liability whatsoever is accepted for any other direct or consequential loss of whatsoever nature and howsoever arising. We do not guarantee that the goods are suitable for any specific purpose even if that purpose is made known to us. We are not responsible for any damage that might be caused as a result of the incorrect application of the goods.

Risk and Title

a) Notwithstanding the delivery of the goods, the goods shall remain the sole and absolute property of Hockley Mint Ltd. as legal and equitable owner until such time as the customer shall have paid us the agreed price.

b) The customer shall (unless otherwise agreed) ensure that all goods which are in the possession or control of the customer, the ownership of which remains with us, are stored so that they may be readily identifiable as belonging to us and we may for the purpose of recovery of our goods, enter upon any premises where they are stored or where they are reasonably thought to be stored and may repossess the same.

c)The customer acknowledges that he is in possession of the goods solely as a fiduciary for us until payment to us for the said goods and in the event the customer sells the goods to a third party, then in such an event, the entire proceeds of the sale are to be held in trust for us and shall not be mingled with other monies or paid into any overdrawn bank account and shall be at all times identifiable as our monies.

Credit of Non Faulty Products

a) Any non-faulty stocked product returned for credit within 30 days of invoice will be given full credit at the price as invoiced. Non-faulty stocked items that are returned after 30 days will be credited at either the price of invoice or based upon current metal prices whichever is lower.

b)Return of non-faulty items which are not stocked or are special order, at any time, will be credited at current prevailing scrap prices.

Prices

Gold and platinum prices will be charged based on the market price at the date of invoice, changed daily. As a result, prices may vary from quoted.

Returns and Shortages

Claims for shortages must be made to the company and the despatch company within five working days. Credits for goods returned that are not faulty are at the company's discretion.

Postage and VAT

Postage, packing, insurance and V.A.T. will be charged where applicable. Customers from EC countries other than the UK must supply V.A.T. number otherwise V.A.T. will be charged at the prevailing UK rate.
